DenialAppeal is a document-preparation tool, not a law firm or attorney. We do not give legal advice, do not represent you, and do not guarantee any appeal result. Plan and state rules vary. You alone are responsible for deadlines and submissions. Review this draft and consult a licensed attorney in your state before relying on or filing anything.

Terms of Service

Pending US licensed counsel review. Draft terms. Governing law and venue are still to be set by counsel. Not legal advice.

1. What this service is

DenialAppeal provides self-help document-preparation software that helps you organize denial information you supply into a draft appeal letter, evidence checklist, and mailing tips. It is not a law firm, not a lawyer, and not a substitute for legal advice.

2. No attorney–client relationship; no legal advice

Using the service does not create an attorney–client relationship. We do not provide legal advice, interpret the enforceability of your plan terms for your case, or predict outcomes.

3. No representation or filing

We do not file appeals, call or negotiate with insurers, appear at hearings, or act as your authorized representative or claims advocate. If you submit anything, you do so yourself (or through counsel you separately retain).

4. No outcome guarantee

Appeal success is never guaranteed. Many appeals are denied. Results vary by plan, facts, and process.

5. Your responsibilities

You are solely responsible for: (a) the accuracy and completeness of information you enter; (b) verifying deadlines and rights in your denial notice and plan documents; (c) deciding whether to submit any draft; and (d) complying with applicable law. You will not present our outputs as attorney work product.

6. Eligibility and scope (v1)

v1 draft types are limited to medical necessity, prior authorization, and out-of-network health-plan denials. Other dispute types are out of scope. A parent/guardian must confirm where a minor’s information is involved.

7. Pre-check and disclaimers

Product screening (“pre-check”) messages are not determinations of your legal rights. You must review and accept the on-site English disclaimers before generation. English site disclaimers control over marketing copy.

8. Acceptable use

You may not ask us to impersonate counsel or file on your behalf; misuse the service for fraud; bypass screening gates; or abuse the system. We may suspend access for abuse or unlawful use.

9. Intellectual property

We own the service software and branding. You retain rights in content you supply. You grant us a limited license to process your content solely to provide the draft you request, subject to the Privacy Policy.

10. Disclaimers of warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, to the maximum extent permitted by law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR FAILED APPEALS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, if you paid nothing.

12. Indemnity

You will defend and indemnify us against claims arising from your content, your submissions to third parties, or your misuse of the service, except to the extent caused by our willful misconduct (final language TBD by counsel).

13. Privacy

Personal and health-related information is handled as described in the Privacy Policy (including default zero persistence for generated drafts).

14. Changes; termination

We may update these Terms by posting a revised version. You may stop using the service at any time. Survival clauses TBD by counsel.

15. Contact / counsel placeholders

Operator contact: support@denialappeal.com (preview address — responses may be delayed). Mailing address: TBD. Governing law, venue, arbitration, and state consumer notices: to be inserted by US counsel before production launch.
